Adherence to labor standards is crucial for sustainable growth and success in the dynamic and ever-evolving business landscape.

Regardless of the size of your business, having a comprehensive understanding of labor laws and regulations is a legal requirement and a means of fostering a positive work environment, promoting employee welfare, and building a reputation as a socially responsible entity.

Businesses that adhere to labor standards contribute to fair competition within the market. Compliance ensures that all companies operate under the same regulations, preventing unscrupulous entities from gaining a competitive advantage by engaging in exploitative labor practices. This fosters an environment where businesses succeed based on merit, innovation, and service quality rather than compromising labor rights.

Earlier this year, the Department of Labor and Employment released the new D.O. 238-23, which focuses on new salient features which introduce new approaches by which the Secretary of Labor and Employment may conduct inspections of establishments through its visitorial and enforcement powers under the Philippine Labor Code. This includes the list of  establishments prioritized for visits, inspections, and/or investigations by DOLE, as follows:

  • Engaged in hazardous work
  • Employing children and/or women
  • Construction projects
  • Philippine-registered ships or vessels engaged in domestic shipping
  • Fishing vessels
  • Engaged in contracting and subcontracting arrangements
  • The subject of Single-Entry Approach (SEnA) referral, anonymous complaint, or request for inspection
  • Other establishments, as may be determined by the Secretary of Labor and Employment

In the Philippines, businesses that understand and prioritize labor standards and compliance reap numerous benefits, ranging from legal protection to enhanced reputation and improved employee welfare.

Compliance with labor laws is not just a matter of fulfilling legal obligations but a testament to an organization’s commitment to ethical practices and social responsibility. By promoting fair labor practices, businesses can forge stronger bonds with their employees, customers, and partners, ultimately driving sustainable growth and success in the competitive business landscape.

The Employers Confederation of the Philippines will hold an online training program on Labor Standards and Compliance this August 14 and 17.  This training program will focus on Books 3-4 of the Labor Code and Special Laws on Labor.
