Designing Employment Contracts

Program Overview

An employment contract is an agreement between the employee and employer that governs the terms and conditions of the employment arrangement. The employment contract is the best evidence of the management as to the type of arrangement agreed with the employee.

What stipulations should an employment contract contain?

There are a lot of factors that we need to understand in developing a contract – types of employment, wages and benefits, working schedules, general duties, and responsibilities. Developing a contract should also consider the nature of the business of the company and important labor laws that apply.

The Employers Confederation of the Philippines (ECOP) will conduct a 2-session training program that will help participants draft and improve their employment contracts.

Program Objectives

At the end of the program, participants will be able to:

  • Design or improve employment contracts (i.e., existing or new draft)
  • Enhance understanding and clarity on the application of law in the design of employment contracts
  • Improve employment contractual stipulations

Program Design

  • Pre-workshop preparation of Participants [to be submitted 1 week before the training]
    • Collate existing and/or draft of employment contracts
    • Identification of critical learning needs and/or focus areas (i.e., specific provisions, type of employment engagement)
  • Review of legal premises and principles of employment contracts
  • Critique of submitted collated contracts/drafts
  • Workshop proper by participants
  • Presentation and critiquing of final output

Program Roadmap (Pre-work)

  1. Participants to be reminded that the Lecture phase of the program is an essential requisite to the Workshop [principles and learnings acquired in the Lecture serve as foundation of the Workshop];
  2. Participants to be forewarned that Resource Person will not be revising and/or drafting contracts in their company’s behalf but will provide inputs and suggestions based on existing and draft contracts submitted;
  3. Participants to submit draft and current employment contracts (in MS Word format) at least 1 week before start of the program:
    • Participants may submit only up to 2 contracts each;
    • Participants to highlight critical provisions needing special focus;
    • Participants to specify areas to concentrate;
  4. Resource person to make initial review of submitted employment contracts:
    • Resource Person to collate submitted contracts and to group as follows:
      • Type of contracts
      • Key contractual provisions
      • Stipulations for focus or with specific concerns

5. Resource Person to customize discussion and workshop focus on submissions of Participants:

    • Discussion to focus on common concerns, issues and needs.
    • Discussions will not identify the company, participant or specific contract under review.

Workshop ProperDays 1 & 2

  1. Presentation of program overview;
  2. Quick review of legal premises and principles of employment contracts;
  3. Resource Person to:
    1. Present collation of submitted contracts and drafts grouped as follows:
      • Type of contracts
      • Contractual provisions
      • Stipulations for focus or with specific concerns

*Provide initial critique and recommendations

  1. Participants to take turns in asking clarifications, inputs and advise from Resource Person (traffic to be managed by Session Moderator);
  2. Participants to revise contractual stipulations (highlighting revisions) and submit to Session Moderator;
  3. Resource Person to:
    • Present collation of resubmitted contracts and drafts.
    • Provide additional critique and comments.
  4. Participants to take turns in asking further clarifications, input and advise from Resource Person (traffic to be managed by Session Moderator);
  5. Wrap up of key learnings and take-aways.

Resource Speaker

ATTY. NOEL D. BALSICAS, C.P.A.

Atty. Noel finished his Bachelor of Science in Commerce (Major in Accounting) from Southwestern University magna cum laude and soon after passed the Accountancy Board Examination. He completed his Bachelor of Laws from the University of Cebu as class salutatorian and immediately thereafter hurdled the Philippine Bar Examination. He also earned a Master’s degree (Master in Management, Major in Business Management) from the University of the Philippines.

Atty. Noel has over 30 years of experience in the fields of human resource management and labor relations as an HR practitioner in the country’s biggest and oldest conglomerate.

Important Notes

  1. The training slot is confirmed only upon receipt of payment. Only confirmed (paid) participants will be given access to the training.
  2. The registration fee must be paid not later than two (2) working days before the first session of the training.
  3. The speaker will make available learning materials that participants will use in this training program. It can be downloaded from our eCampus platform.
  4. The recorded video of the session will be uploaded in our eCampus platform after each training session.
  5. Participants will receive e-certificates after the training.
