ECOP/DOLE Certificate Course on Workplace Compliance and Inspection

Program Overview:

DOLE Department Order No. 183 Series of 2017 authorizes the participation of labor, EMPLOYER and other organizations in the inspection of establishments subject to the requirements of Administrative Order No. 164, Series of 2017. So far, only eighteen (18) out of the 126 representatives of the social partners identify themselves with employers. The consequence is that most of the inspections are being conducted in the absence of a representative from the ranks of employers. This small number of representatives from employers may be attributed to the length and schedule of the conduct of the DOLE training as a prerequisite for the issuance of general authority to participate in the inspection. DOLE conducts this training for a period of ten (10) consecutive days which poses a problem to prospective participants from the employers sector all of whom may find it difficult to leave their full-time jobs.

In this light, ECOP has partnered with the DOLE to run a parallel but similar course which will be conducted over a period of two (2) months. Every week only 2-3 days will be utilized to run parts of the course to enable the participants to be in their workplaces for some days during the same week.

The course will also equip the participants with the skills and knowledge of assisting their companies to comply with the general labor standards, including the requirements of practicing the legitimate forms of job contracting, and occupational safety and health standards, in a pro-active manner. This way, the company does not have to wait for the DOLE to conduct the inspection to find out if it is compliant to labor laws and regulations.

A participant who successfully completes the course will receive a certificate from both ECOP and DOLE. He/she must pass the requisite examination after each module which will be administered by DOLE to be able to represent employers in the inspection. The participant will also receive another certificate as an accredited safety practitioner since the course incorporates the complete module of the Basic Occupational Safety and Health (BOSH) training course. Furthermore, the participant may also decide to take up additional modules, transition to and complete the ECOP’s IR/HR Certification course.

Course OBJECTIVE:

 

The course aims to augment the number of representatives from employers who may be able to participate in the DOLE inspection. It also envisions to engender a culture of compliance on labor laws and regulations among companies.

More specifically, the participant will:

  • Be qualified, as an employer sectoral representative, to accompany a DOLE labor inspector in the inspection of an establishment after passing the requisite DOLE examination for each module;
  • Gain knowledge and skills on workplace compliance specifically on general labor standards, occupational safety and health, prohibition against labor-only contracting (LOC), and labor inspection procedures;
  • Be able to conduct pre-inspection audits, assessments, surveys, and documents examination, necessary to verify a company’s and its supply chain’s compliance to labor standards;
  • Be able to formulate policies and programs to promote a culture of compliance within the company and its supply chain.


Course DESIGN AND METHODOLOGY :

The course is designed based on the DOLE training on labor laws and social legislations for social partners/ sectoral representatives. Some of its modules are also consistent with and credited to the ECOP IR/HR Certification Course should the participant wish to enroll and complete the latter. DOLE requires the course participant to pass an examination after each module in order to qualify as a participant to represent employers in the inspection process.

COMPLETION :

Participants are required to attend and complete all prescribed training modules. Those who have successfully completed any of the BOSH training course conducted by ECOP and modules  7, 8, and 10 under the ECOP IRHR certification course are no longer required to take the modules on OSH, Workplace Relations, and General Labor Standards. Passing the modular examination to be given by DOLE is a requirement to participate as an employer representative during the inspection.
